Part of Nova Scotia County Courts fonds

Series forms part of Nova Scotia County Courts fonds and consists of case files, generated under the Fatality Inquires Act or the earlier Coroners' Act, that contain reports by the Coroner or Medical Examiner outlining the cause and circumstances or deaths in instances where violence or negligence is suspected, the death occurred in prison or jail, or if the place and circumstances of death required explanation. Files provide the name of the deceased and describe events surrounding death as recorded from inquiries by the medical examiner or coroner. The files may contain the records of inquests and the findings of the Coroner's Jury as well as evidence presented to the jury which for more recent deaths might include photographic evidence. Under the legislation the Coroner or Medical Examiner was required to file a report and evidence with the Clerk of the Crown in the local jurisdiction. In this instance the files were maintained as a separate series of County Court case files at the courthouse in Windsor, N.S.

Part of Nova Scotia County Courts fonds

Series forms part of Nova Scotia County Courts fonds and consists of case files relating to applications for naturalization or citizenship heard in Windsor, Hants County. Under the federal Naturalization Act of 1914 the County Court or the Supreme Court in local session was empowered to determine if applicants for naturalization were qualified under the Act. The procedure under the statute was that the when the application was received it would be posted by the Court in a public place. After three months the Court would determine if the alien applicant met the criteria for naturalization and entertain any objections. Upon a positive determination the application would be sent to the Secretary of State for Canada who in general would accept the decision of the court. The certificate of naturalization would then be issued in duplicate with one copy to the now naturalized Canadian and one to be filed in the Court. Additionally form 1915 to 1951 lists of naturalized Canadians were published in the Canada Gazette and can now be found through the Library and Archives Canada website. Files provide information about the applicants' domicile, means of arrival, occupation, date and place of birth, and names of parents, spouse, and children. More recent files contain more detailed information. In addition to the files there is a ledger indexing them and recording court dates and disposition of applications. The index provides personal information about the applicant and also includes some copies of applications. In these case files the distinction between naturalization and citizenship relates to the period in which the application was addressed.

Part of Nova Scotia County Courts fonds

Series forms part of Nova Scotia County Courts fonds and consists of the cause books which record papers issued or filed in each case before the court. Generally the filing of a statement of claim would start the process in which the clerk of the court would assign a number to the case and issue a writ calling upon other parties to respond. The clerk would then record in the cause book the filing of any documents in connection with the case including those generated by the court which may indicate the final disposition of the case. Most cases involved the collection of debt and proceeded no further than the initial writ to other parties. Information recorded includes the names of the parties involved, the name of the plaintiff's solicitor, the case number assigned, any documents filed with the court and the date of filing. The first two volumes in the series are labelled as praecipe books and also record the sum of money sought. These praecipe books generally do not contain information relating to the case subsequent to the initial filing of a claim.

Series forms part of Nova Scotia County Courts fonds and consists of books used by County Court judges to record their decisions on motions or applications heard in chambers. The books record the parties to the case, the date the decision was rendered and the text of the decision or the action taken. From time to time notes on testimony heard are recorded in these books rather than the appropriate evidence book. The decisions were made primarily by: Judges Johnston, (1890-1900); Savary (1900); and Wallace, (1901-1914). Judge Wallace sometimes used shorthand to record his comments.
